Terms of Service

These Terms of Service ("Terms") are an agreement between you and Dan Bui ("we," "us," or "our") for your use of the assistenger service ("the Service"). Please read them. By signing up for or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. What the Service is

assistenger gives you a personal AI assistant that you reach by text message (SMS). You sign up with your mobile phone number, and your assistant can answer questions, help with tasks, and send proactive messages such as reminders and check-ins. The assistant is software, not a person.

2. Your account

You sign in using your phone number and a one-time code we text you. You're responsible for keeping access to your phone secure and for activity that happens under your account. You must be at least 18 years old and able to enter into a contract to use the Service. You agree to give accurate information when you sign up.

3. Acceptable use

You agree not to use the Service to:

• break any law or regulation;
• harm, harass, threaten, or impersonate others;
• send spam or unsolicited messages, or abuse the messaging system;
• attempt to hack, overload, reverse-engineer, or disrupt the Service;
• upload or share content that is illegal, harmful, or infringes others' rights;
• use the Service to make decisions that legally or medically require a licensed professional.

We may suspend or end your access if you violate these Terms or misuse the Service.

5. Use at your own risk; no warranty

The Service is provided "as is" and "as available," and you use it at your own risk. To the fullest extent allowed by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that the assistant's output will be accurate or reliable.

6. Limitation of liability

To the fullest extent allowed by law, Dan Bui and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three (3) months before the claim, or USD $100 if you paid nothing.

7. Fees and trials

Some features may be offered with a free trial or for a fee. If paid plans apply, the price and billing terms will be presented to you before you're charged. We may change pricing with reasonable notice.

8. Messaging

The Service uses SMS text messaging. Message and data rates may apply, and message frequency varies. You can reply STOP to opt out of texts or HELP for help at any time. See our Privacy Policy for how we handle your phone number and messages.

9. Termination

You can stop using the Service at any time. We may suspend or terminate the Service, or your access to it, at any time — for example, for violations of these Terms or to protect the Service. Sections that by their nature should survive termination (such as disclaimers and limitation of liability) will continue to apply.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date above. If you keep using the Service after changes take effect, you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any disputes will be handled in the courts located in Michigan, unless applicable law requires otherwise.
